1. Acceptance of Agreement

By creating an account, connecting an email provider (Gmail/Outlook), or accessing the DataAssistant-ai platform (the "Service"), you agree to be legally bound by these Terms of Use and our Privacy Policy. If you do not agree to these terms, you are prohibited from using the Service.

2. Description of Service

DataAssistant-ai provides an AI-orchestration layer for email management, including RAG-based Smart Replies, Knowledge Base management, and an Approval Queue. The Service acts as a processor that facilitates communication between you and your third-party email providers.

3. Data Ownership & No-Resale Guarantee

  • User Ownership: You retain 100% ownership of all email content, metadata, and Knowledge Base files processed through the Service. DataAssistant-ai claims no proprietary rights over your data.

  • Strict No-Resale Policy: DataAssistant-ai strictly prohibits the sale, rental, or leasing of user email data or account information. We guarantee that your data will never be sold to third-party data brokers, advertisers, or any other entities. Your data is used exclusively to provide the features of the Service.

4. Permanent Deletion Right

You have the absolute right to be forgotten. The Service includes a Permanent Delete function within the user settings.

  • Execution: Upon activation, the Service will immediately revoke all OAuth permissions and permanently purge all synchronized metadata and stored Knowledge Base embeddings from our production databases.

  • Finality: You acknowledge that this action is irreversible. Once the Permanent Delete command is executed, DataAssistant-ai cannot recover any of the purged information.

5. User Responsibilities & AI Accuracy

  • Human-in-the-Loop: DataAssistant-ai utilizes advanced AI to generate drafts. You acknowledge that AI can produce "hallucinations" or factual inaccuracies. You are solely responsible for reviewing, editing, and approving all content in the Approval Queue before it is sent.

  • Prohibited Use: You agree not to use the Service for high-risk activities, the transmission of malware, or the distribution of "spam" in violation of the CAN-SPAM Act or similar international regulations.

6. Subscriptions and Quotas

Use of the Service is subject to the limitations of your selected subscription tier.

  • Usage Caps: "Hard Quotas" apply to the number of AI-assisted replies generated.

  • Billing: All fees are non-refundable. Failure to maintain an active subscription may result in your account being moved to a "Read-Only" state or scheduled for deletion after a period of prolonged inactivity.

7. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, DATAASSISTANT-AI SHALL NOT BE LIABLE FOR ANY DAMAGES RESULTING FROM AI-GENERATED CONTENT, LOSS OF DATA DUE TO THIRD-PARTY API FAILURES (GOOGLE/MICROSOFT), OR UNAUTHORIZED ACCESS TO YOUR ACCOUNT RESULTING FROM YOUR FAILURE TO SECURE YOUR LOGIN CREDENTIALS.

8. Termination

We reserve the right to suspend or terminate your access for violations of these Terms. You may terminate your account at any time by using the Permanent Delete function.
